Regulation SHO


In order to modernize and provide a new regulatory framework governing short selling of securities since the short sale regulation was first adopted in 1938, the US Securities and Exchange Commission (SEC) adopted Regulation SHO in June of 2004.  Regulation SHO is designed, in part, to fulfill several objectives, including: (a) establishing uniform locate and delivery requirements in order to address problems associated with failures to deliver, including potentially abusive "naked" short selling (i.e., selling short without having borrowed the securities to make delivery); and (b) creating uniform marking requirements for sales of all equity securities. Regulation SHO also required the Exchange to amend its rules with respect to activities associated with the short selling of securities, so that the rules do not conflict with the regulation.

Threshold Securities - NYSE

Regulation SHO requires SROs to disseminate a daily list of threshold securities where such SRO is the primary listing venue for any such security. Learn more about the Regulation SHO requirement and access daily lists of threshold securities.

Regulation SHO Pilot Lists - NYSE

The Exchange will continue to publish a downloadable file of all NYSE-listed securities labeled “Pilot List A” until further notice in order to provide the industry with more time to build systems to facilitate the elimination of the price test.

Short Sale Data - NYSE and NYSE Arca

All SROs must make short sale data available beginning in January 2005 through August 2007.

NYSE Short sales transactions data is available on a monthly basis from nysedata.com.
