NYSE AMEX LLC TO DELIST SECURITIES OF THE SINGING MACHINE COMPANY, INC.

New York, October 29, 2009 – NYSE Amex LLC announced today its final determination to remove the common stock (the “Securities”) of The Singing Machine Company, Inc. from listing on the Exchange, and filed an application on Form 25 to strike the Securities from listing with the Securities and Exchange Commission (the “SEC”). The delisting will become effective on November 9, 2009 unless postponed by the SEC.
Pursuant to its rules, the Exchange provided notice to The Singing Machine Company, Inc. of the decision to delist the Securities and an opportunity to appeal the decision to a panel of a committee appointed by the Board of Directors of NYSE Amex.
In addition to this press release, NYSE Amex LLC will provide public notice of its determination on its website. Notice will remain posted on the website until the delisting is effective.
